SalonLynk Terms of Service

Welcome to SalonLynk! These Terms of Service (“Terms”) govern your use of our website, app, and services (collectively, the “Services”). By creating an account or using our Services, you agree to these Terms. If you do not agree, please do not use SalonLynk.

1. Eligibility
You must be at least 18 years old and legally allowed to provide cosmetology or other professional services in your jurisdiction. By using SalonLynk, you confirm that you meet these requirements.
2. Account Responsibilities
You are responsible for maintaining the security of your account, including your login credentials. You agree to notify us immediately if your account is accessed without your permission. You are responsible for all activity under your account.
3. Payments and Fees
If you use paid features, you agree to pay all applicable fees. You authorize us and our payment processors to charge your payment method for these fees.
All fees are non-refundable unless otherwise stated.
4. Use of Services
You agree to use the Services only for lawful and professional purposes. You may not:
Use the Services to harass, threaten, defame, or harm anyone.
Violate intellectual property or privacy rights.
Interfere with, disrupt, or attempt to bypass the Services or related security controls.
Use SalonLynk for any activity prohibited by law or relevant licensing bodies.
5. Client Communications
SalonLynk provides tools for communicating with your clients. You are solely responsible for:
Obtaining all required consents
Complying with U.S. laws including the TCPA, CAN-SPAM Act, and any state-specific rules
Ensuring your messages are professional, lawful, and accurate
SalonLynk is not responsible for your communications with clients.
6. User Content
“User Content” includes anything you upload, publish, or share using the Services. You represent that:
You own or have permission to use the content
Your content does not violate any third-party rights
You are fully responsible for fees, royalties, or legal claims related to your content
SalonLynk may remove content that violates these Terms or applicable laws.
7. AI-Generated Content
Some features may use AI to generate text, images, or other content.
You own your inputs and outputs, but you are responsible for reviewing and verifying accuracy, legality, and compliance before using AI-generated content.
Our AI providers may use anonymized inputs and outputs to improve their systems.
8. Third-Party Services
SalonLynk integrates with third-party services such as payment processors, email systems, and analytics tools.
You must comply with their terms.
SalonLynk is not responsible for third-party actions, outages, or content.
9. Gift Cards
If you sell gift cards using SalonLynk, you are the issuer.
You are solely responsible for compliance with all applicable laws regarding:
Expiration rules
Refunds
Unclaimed property
Lost or stolen cards
SalonLynk does not assume liability for gift card disputes.
10. Age Requirements
You must be 18 or older to use SalonLynk.
SalonLynk does not knowingly collect information from children under 13.
If information from a child under 13 is discovered, we will delete it immediately.
11. Termination
We may suspend or terminate your account at any time if we believe you violated these Terms or applicable laws.
After termination:
You must stop using the Services
Outstanding fees remain your responsibility
Payouts may be delayed for investigation or fraud prevention
Termination does not limit SalonLynk’s legal remedies.
12. Authorized Access & Account Delegation
If you enable the “Authorized Access” feature:
You grant SalonLynk permission to access your account solely to assist with setup, troubleshooting, or system configuration
You may disable this feature at any time
SalonLynk will not access your account unless this feature is enabled
You acknowledge that actions taken during this period are authorized by you
13. Communications
By using the Services, you consent to receive messages related to your account, appointments, updates, and features.
You may receive promotional messages; you can opt out at any time via unsubscribe links or by emailing salonlynk@gmail.com.
14. Warranties
You represent and warrant that:
You are 18+ and legally able to use the Services
You will comply with all applicable laws and licensing requirements
You have the right to upload or share any User Content
15. App Provider Terms
Use of the SalonLynk mobile apps requires compatible devices.
Apps may be updated automatically.
Carrier data fees may apply.
Apple, Google, and other platform providers are not responsible for the Services.
16. Indemnification
You agree to defend, indemnify, and hold SalonLynk harmless from claims, losses, or damages arising from:
Your use of the Services
Your User Content
Your violation of these Terms
Your violation of any law or third-party rights
17. Disclaimer of Warranties
The Services are provided “as is” and “as available.”
SalonLynk does not guarantee uptime, accuracy, or compatibility.
We are not responsible for user errors, data loss, or third-party actions.
18. Limitation of Liability
SalonLynk’s total liability to you is limited to the amount of fees you paid in the past 12 months.
We are not liable for indirect, incidental, or consequential damages.
Your sole remedy is to stop using the Services.
19. Arbitration and Jury Waiver
Any disputes will be resolved through binding arbitration under AAA rules.
You waive the right to:
a court trial
a jury trial
class actions
Claims under $10,000 may be handled through written submissions.
The arbitration venue is New York County, NY, unless both parties agree otherwise.
20. Assignment and Transfer
(Critical clause for HB → AB → LLC transition)
SalonLynk may assign or transfer these Terms, in whole or in part, to another legal entity as part of a restructuring, incorporation, merger, acquisition, or similar business transition. Such assignment does not require your additional consent. You will be notified if such a transfer occurs.
21. Entire Agreement
These Terms, together with the Privacy Policy, Data Processing Addendum (if applicable), and Acceptable Use Policy, form the entire agreement between you and SalonLynk.
22. Miscellaneous
These Terms are governed by the laws of New York, USA
Your use of the Services does not create any partnership, agency, or employment relationship
You may not assign your rights without written permission
SalonLynk may assign these Terms as allowed under Section 20
23. Copyright Claims
If you believe content on SalonLynk infringes your copyright, email salonlynk@gmail.com.
You may submit a counter-notice under DMCA guidelines.
24. Changes to These Terms
We may update these Terms from time to time.
If changes are material, we will notify you by email or through the Services.
Updated Terms become effective when posted unless otherwise stated.
Your continued use of the Services constitutes acceptance.
